TERMS & CONDITIONS

**1. Introduction** 

Welcome to the Heppells Chocolatier Patissier Ltd Website (the “Site”). Heppells Chocolatier Patissier provides this Site as a service to its customers. Please review the following Terms and Conditions that govern your use of our Site (the “Agreement”). By using our Site, you agree to follow and be bound by these terms. If you do not agree to these terms, please do not use this Site. Although you may "bookmark" a specific section of this Site and thus bypass this Agreement, your use of the Site still binds you to the terms. Heppells Chocolatier Patissier may revise this Agreement at any time, and you may wish to visit this page periodically for updates.

 

**2. Online Registration & Security** 

2.1 When ordering from Heppells Chocolatier Patissier, you have the option to (1) create an account or (2) use guest checkout. You are responsible for ensuring that all details provided during account creation and ordering are complete and accurate. 

2.2 When you register to use the Site, you will be asked to select an account password. You are responsible for all activities and orders that occur under your account, and you should keep your password confidential. If you suspect that someone else knows your password, you should change it immediately. If we believe there may be a security breach or misuse of the Site, we may require you to change your password or we may suspend or cancel your account.

 

**3. Colors, Specifications & Descriptions of Products** 

We have made every effort to display the colors, specifications, dimensions, and descriptions of items on the Site as accurately as possible. However, the colors you see will depend on the resolution of your monitor. We cannot guarantee that your monitor's display will always accurately reflect the color of the item delivered. From time to time, we may vary the dimensions, specifications, descriptions, and quantities of items displayed on our Site without prior notice.

 

**4. Allergens** 

All of our products are packaged in a production kitchen that handles nuts, milk, soy, eggs, gluten, wheat, and barley. While some products may be marked as low-gluten (i.e., they do not contain flour in the recipe), they should not be considered gluten-free, as they are prepared in a kitchen that handles flour.

 

**5. Prices** 

The prices we charge for our products will be as stated on the Site. Prices are inclusive of any applicable VAT. You will also need to pay for any delivery charges specified during the order process.

 

**6. Ordering & Payment** 

6.1 When completing an online order, it is your responsibility to ensure the accuracy and completeness of the information you provide. Heppells Chocolatier Patissier accepts no responsibility for items that cannot be delivered or for incorrect or incomplete delivery information. 

6.2 We must receive payment for the products before your order can be accepted. To process your order, we require details of a valid credit or debit card. Your card will be automatically charged for the products ordered plus any applicable delivery charges.

 

**7. The Contract** 

Once payment has been received, we will confirm your order by sending an email to the address you provided. Our acceptance of your order creates a legally binding contract between us. After this point, you cannot withdraw or cancel your order except as stated in clause 8.

 

**8. Cancellation & Modification of Orders** 

8.1 The right of withdrawal within 8 days does not apply to perishable food items such as boxed chocolates, cakes, and chocolate bars. 

8.2 Cancellation or modification of orders may be accepted until the product is handed over to the carrier. 

8.3 Modification of cake orders may be accepted up until 48 hours prior to collection from the Heppells Chocolatier Patissier shop. 

8.4 We reserve the right to cancel the contract between us if: (a) we have insufficient stock to deliver the products you ordered; (b) we do not deliver to your area; or (c) one or more of the products you ordered was listed at an incorrect price due to a typographical error. 

8.5 In the event of cancellation, we will notify you by email or phone and will refund any sums deducted from your account.

 

**9. Class Bookings** 

9.1 Heppells Chocolatier Patissier reserves the right to cancel or change a class. In such cases, Heppells Chocolatier Patissier will offer an alternative class date or an alternative class of equal value. Heppells Chocolatier Patissier is not liable for any travel or accommodation expenses incurred due to a class being canceled or rearranged. 

9.2 Heppells Chocolatier Patissier cannot offer any refunds should you decide to cancel or are unable to attend your class. We advise students to arrange adequate insurance to cover unforeseen events such as adverse weather, illness, or class cancellations that incur travel and accommodation costs. 

9.3 In the event of unforeseen circumstances preventing the advertised tutor from delivering the course, Heppells Chocolatier Patissier will take appropriate measures to address the situation.

 

### 9. Class Rescheduling Policy 

**9.4(a)** To reschedule a half-day class, you must notify Heppells Chocolatier Patissier at least 14 days in advance. You may transfer to another class within this period if Heppells Chocolatier Patissier can re-sell your spot to another student. Transfer requests will be considered at the discretion of Heppells Chocolatier Patissier.

 

**9.4(b)** To reschedule a two or three-day masterclass, you must inform Heppells Chocolatier Patissier at least 30 days prior to the masterclass. Transfers to another masterclass within this time frame are allowed only if Heppells Chocolatier Patissier can find another student to take your place. This transfer is also at the discretion of Heppells Chocolatier Patissier.

 

### 9. Attendance 

**9.5** Students must arrive at The Chocolate & Pastry School 10 minutes before the scheduled start time. We cannot issue refunds or offer to rebook for late arrivals.

 

### 9. Media Release 

**9.6** You may be photographed or filmed during your class. Heppells Chocolatier Patissier may use these images and recordings for promotional purposes on the website and in media worldwide for an indefinite period.

 

### 9. Food Liability 

**9.7** You release us from all claims, damages, or liabilities arising from the preparation, storage, and consumption of food taken home from your class, except in cases of our negligence. 

 

**9.8** You agree to indemnify and hold us and our employees harmless from any loss of personal property you experience while at Heppells Chocolatier Patissier, as well as any injuries or damages that you or anyone connected to you may sustain related to food preparation, unless such injuries or damages result from our negligence.

 

**9.9** Our liability to you will not exceed the total price charged for any class booked. This does not exclude our liability for personal injury or death caused by our negligence.

 

**9.10** Recipes may have been prepared using shared equipment that processes allergens such as wheat, dairy, eggs, nuts, fish, soy, shellfish, and others. Please inform your tutor about any food allergies upon arrival. You agree to consider the dietary restrictions of anyone who may consume the food you prepare during class.

### 10. Gift Vouchers 

**10.1** Gift vouchers are redeemable at [www.cocoablack.com](http://www.cocoablack.com), subject to these terms and conditions. 

 

**10.2** Gift vouchers can be exchanged for products of a higher value by paying the difference. 

 

**10.3** Gift vouchers are valid for 12 months from the date of issue. 

 

**10.4** Heppells Chocolatier Patissier is not liable for lost, stolen, or damaged gift vouchers. 

 

**10.5** Gift vouchers cannot be exchanged for cash or used to purchase other gift vouchers. 

 

**10.6** Gift vouchers are non-returnable and non-refundable, except as required by law. 

 

**10.7** Gift voucher balances will be updated after each online transaction. 

 

**10.8** Heppells Chocolatier Patissier reserves the right to refuse any gift voucher that appears to be tampered with, duplicated, damaged, or suspected to be fraudulent. 

 

**10.9** If an item purchased with a gift voucher is exchanged for a less expensive item or refunded, any remaining balance will be added back to the gift voucher.

### 11. Delivery & Collection 

**11.1** For products delivered by mail, we will send them to the address you provide when ordering. Please ensure this information is complete and accurate, as any charges for forwarding the package to another address will be your responsibility. 

 

**11.2** For products collected from Heppells Chocolatier Patissier (e.g., cakes), we will hold your order for 24 hours after the stated collection time. If not collected within this period, your order will be disposed of. 

 

**11.3** We are not liable for any damage to products or delivery issues caused by events beyond our reasonable control. 

 

**11.4** You become the owner of the product upon collection from Heppells Chocolatier Patissier or upon its delivery to your specified address. 

 

**11.5** We do not accept liability if your delivery is stolen or damaged while on your doorstep. 

 

**11.6** You agree to inspect perishable products upon collection or delivery and notify us via email of any defects within 48 hours. For equipment delivered, please inspect it and notify us within seven days. Claims made outside of these periods will not be accepted.

### 12. Returns

12.1 If your item does not come with a manufacturer’s warranty, returns must be initiated within 30 days. 

12.2 For items covered by a valid manufacturer’s warranty, returns are accepted until the warranty expires. 

12.3 When returning a product, please include your online order number or receipt, an accurate note detailing any defects (if applicable), and the item being returned.

12.5 Our Returns department will evaluate all returned items. If your claim is validated, we will reimburse reasonable postal costs associated with the return. 

 

### 13. Liability

13.1 We strive to provide accurate information on our Site, but we cannot be held responsible for any inaccuracies that may occur. We may correct any mistakes, and we won’t be liable for any consequences that arise from such inaccuracies or for any technical issues encountered on the Site. 

13.2 If your order does not arrive, or if we deliver incorrect or damaged products, our liability is limited to: (a) remedying any non-delivery; (b) replacing missing items; (c) replacing damaged or defective products; or (d) refunding the amount you paid for the affected products. 

13.3 The above limitations do not cover defects or faults resulting from your misuse, neglect, or accidents that occurred while the product was in your possession. 

13.4 Except as prohibited by law, Heppells Chocolatier Patissier will not be liable for any indirect or consequential losses, damages, or expenses (including loss of profits or goodwill) arising from any issues you raise under this condition. Our only obligation is to refund the amount you paid for the products in question. 

13.5 Heppells Chocolatier Patissier, and all associated parties, exclude any liability for losses or damages of any sort stemming from your use of this Site, including but not limited to issues with computer viruses that may affect your equipment, software, or data. 

13.6 You are responsible for complying with all applicable regulations and obtaining any necessary customs or import permits to purchase products from our Site. Some products may be prohibited from import or export by law. We make no guarantees concerning the legality of importing or exporting the products you buy. 

13.7 Notwithstanding anything stated above, nothing in these Terms & Conditions is intended to limit your rights as a consumer under relevant local laws or to exclude or limit our liability for any death or personal injury caused by our negligence. 

 

### 14. Resale

Reselling our products is not permitted. 

 

### 15. Intellectual Property

Unless otherwise specified, all materials on this Site, including images, designs, recipes, tips, videos, and written content (collectively referred to as the “Contents”), are protected intellectual property belonging to Heppells Chocolatier Patissier. This Site and its Contents are intended for commercial use only. You may not reproduce, distribute, display, modify, create derivative works from, sell, or exploit any part of the Contents or the Site in any manner.

16. **Governing Law** 

The contract between us will be governed by and interpreted in accordance with the laws of Scotland. Any disputes that arise between us will fall under the jurisdiction of the Scottish courts.

 

17. **Invalidity** 

If any part of these Terms & Conditions is deemed invalid by a court with the appropriate jurisdiction, that invalidity will not affect the validity of the other provisions, which will remain in full effect.

 

18. **Third Parties** 

The provisions of the Contracts (Rights of Third Parties) Act 1999 are specifically excluded from our contractual relationship, meaning that no third party can claim rights under this relationship. This does not impact any existing rights or remedies of third parties that are available outside of that Act.

 

19. **User Feedback & Other Submissions** 

Any comments, suggestions, ideas, or submissions (collectively referred to as “Comments”) made to Heppells Chocolatier Patissier through this Site or any other means become the property of Heppells Chocolatier Patissier. By submitting Comments, you assign all rights, titles, and interests in those Comments to Heppells Chocolatier Patissier, granting them exclusive ownership of all related intellectual property rights. Heppells Chocolatier Patissier is not obligated to (a) keep any Comments confidential; (b) provide compensation for Comments; or (c) respond to any Comments. You agree that your Comments will not infringe on any third-party rights, including copyrights, trademarks, or personal rights, and will not contain anything illegal, abusive, or obscene. You are solely responsible for the content of any Comments you make.

 

20. **Links to Third Party Websites** 

This Site may include links to websites not controlled by Heppells Chocolatier Patissier. We take no responsibility for the content of these linked websites and do not necessarily endorse them. Links are provided solely for user convenience and information.

 

21. **Disclaimer** 

Heppells Chocolatier Patissier provides the materials on this Site “as is” without any warranties, either express or implied. This includes, but is not limited to, implied warranties of merchantability or fitness for a particular purpose. Heppells Chocolatier Patissier has no obligation to update or revise the materials on the Site but may modify them at any time without notice. By using this Site, you acknowledge that you do so at your own risk and assume full responsibility for all costs related to any necessary maintenance or repairs of your equipment. 22. **Entire Agreement** 

These Terms & Conditions, along with our current pricing, delivery details, contact information, and Privacy Policy, constitute the entire agreement between us regarding the supply of products. Nothing said by anyone on our behalf should be interpreted as a modification of these Terms & Conditions or as an authorized representation regarding the nature or quality of any products sold by us. Aside from instances of fraud or fraudulent misrepresentation, we are not liable for any reliance placed on such representations if they turn out to be untrue or misleading. misleading.
