TERMS & CONDITIONS

1. Introduction

Welcome to the Heppells Chocolatier Patissier Ltd Website (the “Site”). These Terms and Conditions (the “Agreement”) govern your use of our Site and the purchase of any goods or services. By using our Site or placing an order, you agree to be bound by these terms. We may update these terms from time to time; the version active at the time of your order will apply to that contract.

2. Online Registration & Security

2.1 You may create an account or use guest checkout. You must ensure all details provided are accurate.

2.2 You are responsible for maintaining the confidentiality of your password. We reserve the right to suspend accounts if we suspect a security breach or misuse.

3. Product Descriptions & Accuracy

3.1 We make every effort to display colors and specifications accurately. However, as digital displays vary, the delivered product may have slight variations.

3.2 We reserve the right to vary dimensions or specifications of products to reflect changes in relevant laws or regulatory requirements, or to implement minor technical adjustments.

4. Allergens & Food Safety

4.1 Warning: All products are prepared in a environment that handles nuts, milk, soy, eggs, gluten, wheat, and barley.

4.2 While some products are made without gluten-containing ingredients, we cannot guarantee a 100% "Gluten-Free" environment due to the presence of flour in our production kitchen.

5. Pricing & Payment

5.1 Prices include VAT at the current rate. Delivery charges will be clearly displayed before you confirm your order.

5.2 Payment is required in full at the time of ordering via a valid debit or credit card.

6. Formation of Contract

6.1 Your order is an offer to buy from us. A legally binding contract is formed only when we send you an Order Confirmation email.

6.2 If we cannot accept your order (e.g., item out of stock or pricing error), we will inform you and refund any payment taken.

7. Cancellation Rights (Consumer Contracts Regulations)

7.1 Perishable Goods: Under UK law, the right to cancel and receive a refund within 14 days does not apply to goods that are liable to deteriorate or expire rapidly. This includes our chocolates, cakes, and pastries.

7.2 Non-Perishable Goods: For equipment or gift items, you have the right to cancel within 14 days of receipt. You must return the items at your own cost in their original condition.

7.3 Cancellations/Modifications: * Standard Orders: May be modified until they are dispatched.

  • Bespoke/Cake Orders: Modifications must be requested at least 48 hours before the scheduled collection or delivery.
     

8. Class Bookings & Rescheduling

8.1 Cancellations by Us: If we cancel a class, we will offer a full refund or a transfer to an alternative date. We are not liable for your travel or accommodation costs.

8.2 Cancellations by You: As classes are scheduled services for a specific date, they are generally exempt from the statutory 14-day cooling-off period.

  • Half-day classes: 14 days' notice is required to request a reschedule.

  • Masterclasses (2+ days): 30 days' notice is required.

  • Discretion: Transfers requested inside these windows are only permitted if we can refill your spot.

8.3 Attendance: No refunds are provided for late arrivals or "no-shows."

9. Media & Liability (Classes)

9.1 Media Release: We may take photos/videos during classes for promotional use. If you do not wish to be filmed, please inform the tutor upon arrival.

9.2 Personal Property: We are not liable for loss or damage to personal property unless caused by our negligence.

9.3 Injury: Nothing in these terms excludes our liability for death or personal injury caused by our negligence.

10. Gift Vouchers

10.1 Vouchers are valid for 12 months from the date of issue.

10.2 Vouchers cannot be exchanged for cash and are non-refundable (except where statutory cancellation rights apply to the initial purchase).

11. Delivery & Collection

11.1 We are responsible for the goods until they are delivered to your door or collected by you.

11.2 Inspection: Please inspect perishable goods upon receipt. You must notify us of any damage or errors within 24 hours for perishables, or 30 days for non-perishable equipment (under the Consumer Rights Act 2015).

11.3 Non-Collection: Cakes not collected within 24 hours of the agreed time will be disposed of without refund due to food safety regulations.

12. Faulty Goods (Your Statutory Rights)

12.1 Under the Consumer Rights Act 2015, goods must be as described, fit for purpose, and of satisfactory quality.

12.2 If a product is faulty, you are entitled to:

  • Up to 30 days: A full refund.

  • Up to 6 months: A repair or replacement (or refund if we cannot repair/replace).
     

13. Limitation of Liability

13.1 We do not exclude or limit our liability where it would be unlawful to do so.

13.2 We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract. We are not responsible for any loss or damage that is not foreseeable.

13.3 We only supply products for domestic and private use. We have no liability for loss of profit, loss of business, or business interruption.

14. Intellectual Property & Use of Site

14.1 All content on this Site (images, recipes, designs) is the property of Heppells Chocolatier Patissier Ltd.

14.2 You may not use our content for commercial purposes without a license from us.

15. Data Protection

Your personal information will be processed in accordance with our Privacy Policy and UK GDPR.

16. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
